1. Acceptance of these terms

These terms form an agreement between you and Moonlit Arcade ("we", "us"), the operator of moonlitarcade.ca. By opening, browsing or otherwise using this website you accept them in full. If you do not accept them, please do not use the site.

2. Age requirement

This website is intended exclusively for adults aged 18 or over, and 19 or over in provinces and territories where that is the age of majority. By confirming the age notice you represent that you meet that requirement.

We restrict access because our editorial content discusses games containing mature themes, strong language and adult humour. We may withdraw access from any visitor we reasonably believe to be under the applicable age. Parents and guardians who share a device are encouraged to use the parental control features built into their operating system or browser.

3. Nature of the service

Moonlit Arcade is an independent editorial publication. We describe, review and recommend casual games. We are not a developer, publisher, distributor or reseller of any title referred to on this site, and we do not host playable software.

4. No real-money play

Nothing on this website involves money changing hands. There is no purchase, deposit, entry fee, prize pool or cash-out mechanism of any kind, and we do not review or link to products that offer one. Scores, streaks and leaderboards carry no monetary value and cannot be exchanged, transferred or redeemed.

If a title we have listed later introduces paid chance-based mechanics, we remove the listing at the next editorial review.

5. Acceptable use

You agree not to:

  • use the site in a way that breaches any applicable federal, provincial or territorial law;
  • misrepresent your age in order to obtain access;
  • attempt to gain unauthorised access to any part of the site, its servers or connected systems;
  • scrape, mirror, frame or systematically copy our content without written permission;
  • introduce malware, or interfere with the availability of the site for others;
  • send us unsolicited commercial messages contrary to Canada's anti-spam legislation;
  • use automated tooling to submit the contact form.

6. Intellectual property

All editorial text, page structure, design, code and original graphics on this site are owned by Moonlit Arcade and protected by Canadian and international copyright law. You may read, print and share individual pages for personal, non-commercial use with attribution and a link.

Game titles, logos, screenshots and trademarks belong to their respective owners and are used here for the purpose of identification, review and commentary — a use recognised as fair dealing under the Copyright Act. Photographs are licensed from third-party stock libraries and may not be extracted from this site for reuse.

7. Your submissions

If you send us a suggestion, correction or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, adapt and publish it in connection with the site. You confirm that the material is yours to send and that it does not infringe anyone else's rights. We are not obliged to publish or respond to any submission, and we do not pay for unsolicited material.

8. Third-party links

Our pages link to external websites operated by others. Those links are provided for convenience and do not imply endorsement. We do not control third-party sites and are not responsible for their content, availability, security or privacy practices. Review their terms before using them.

9. Availability and changes

We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend or withdraw all or part of the site, and may update these terms, at any time. The "last updated" date shows the current version, and continued use after a change means you accept the revised terms.

10. Disclaimer

Editorial content is provided for general information and entertainment. It reflects our reviewers' opinions at the time of writing. Games change: features, content ratings and monetisation may differ from what we describe. To the maximum extent permitted by law, the site is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of this site or of any third-party site reached from it. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. The courts of Ontario have exclusive jurisdiction over any dispute, except that consumers may bring proceedings in the courts of their own province where the law gives them that right. Nothing here affects your rights under applicable consumer protection legislation.
